YouTube imprint obligation – what you should know

by Michaela

Not every YouTuber needs an imprint, but for many it is obligatory. We tell you when you need it and when you don’t.

Imprint on YouTube – only conditionally obligatory

If you have a YouTube channel, you need to find out whether you fall under the imprint obligation or not.

  • Legally speaking, you need an imprint as soon as your YouTube channel becomes opinion-forming. If you regularly upload videos that have a business or editorial character, you are required to have an imprint according to the German Telemedia Act.
    • It is not important how many followers you have, but what content you post. Even channels with few followers and regular posts that have a business character need an imprint.
    • If you are a blogger, company, association, authority or foundation on YouTube, you definitely need an imprint. Even if you are a private person and occasionally place advertisements or include collaborations, you must provide an imprint on YouTube.
    • If you rarely upload a video, have a low number of clicks and do not intend to earn money with YouTube, you do not need an imprint.
      • You can play it safe if you only want to share your uploaded videos with friends or family and set them to private. In this case, you do not need an imprint on YouTube.
You should add the imprint on YouTube in the category “Channel info”. You can have your own imprint generated on the e-Recht24.com website.

In the next practical tip, we will show you how to deactivate the video overlays on YouTube.
